Chapter 94C of the General Laws is hereby amended by inserting after section 24B the following section:-
Section 24C. (a) Upon receiving a report of examination or treatment of a person with injuries resulting from an opiate overdose, pursuant to section 12A of chapter 112, or a report of an opiate overdose-related death from the chief medical examiner, pursuant to section 16 of chapter 38, of an individual who was prescribed an opiate within 12 months of said death or overdose, the department shall notify the provider who prescribed the opiate through the prescription monitoring program health in a manner determined by the commissioner that complies with 42 U.S.C. section 290dd-2, 42 C.F.R. Part 2 and 45 C.F.R. section 164.512.
(b) Upon diagnosing a patient with an opioid use disorder, a diagnosing provider shall submit to the department, by electronic means, information regarding said diagnosis in a manner determined by the commissioner that complies with 42 U.S.C. section 290dd-2, 42 C.F.R. Part 2 and 45 C.F.R. section 164.512. If said patient was prescribed an opiate within 12 months of said diagnosis, the department shall notify the provider who prescribed the opiate through the prescription monitoring program health in a manner determined by the commissioner that complies with said 42 U.S.C. section 290dd-2, said 42 C.F.R. Part 2 and said 45 C.F.R. section 164.512.
