An Act relative to expanding the availability of sharps disposal sites.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The General Laws are hereby amended by inserting after section 27A of chapter 94C the following section:-
Section 27B. Notwithstanding any general or special law to the contrary, the department of environmental protection and the department of public health, in conjunction with other relevant state and local agencies and government departments, shall promulgate regulations that require a pharmacy located in the commonwealth to maintain a sharps disposal container for the collection and disposal of spent hypodermic needles and lancets on their premises. A sharps disposal container located at a pharmacy shall be made available to the public at no charge. Regulations shall include, but not be limited to, the availability of a sharps disposal container to the public, required maintenance of a sharps disposal container and clear advertisement of the availability of a sharps disposal container.
