An Act relative to retirement benefits for Kevin Wilder.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. (a) Notwithstanding section 12 of chapter 32 of the General Laws or any other general or special law to the contrary, the state board of retirement shall provide Cynthia Smith Wilder, the surviving spouse of Kevin Wilder, a lifetime, monthly allowance equal to 62 per cent of the average annual rate of regular compensation Kevin Wilder received during: (1) any period of 3 consecutive years of creditable service for which such rate of compensation was the highest; or (2) the period or periods, whether consecutive or not, constituting his last 3 years of creditable service preceding retirement, whichever is the greater.
(b) Any retirement benefit provided to Cynthia Smith Wilder pursuant to this act shall be in lieu of, and shall not be in addition to, any benefits she may have otherwise received from the state board of retirement as Kevin Wilder’s beneficiary.
