An Act establishing a commission to study the offshore wind investment tax credit.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. There shall be a commission established to study the impact to the offshore wind industry in the commonwealth due to the expiration of the offshore wind Investment Tax Credit pursuant to Section 48 of the Internal Revenue Code. The commission shall examine the benefits derived by the Investment Tax Credit and consider the negative consequences to the industry upon its expiration, including, but not limited to, economic development, labor and workforce, growth of the industry, and the ability of the commonwealth to attract the offshore wind supply chain. The commission shall also consider any policies and programs that could alleviate any negative impacts recognized by the expiration of the Investment Tax Credit. The commission shall be comprised of the secretary of the executive office of housing and economic development, or a designee, who shall be the chair; the secretary of the executive office of labor and workforce development, or a designee; the secretary of the executive office of administration and finance, or a designee; the secretary of the executive office of energy and environmental affairs, or a designee; the house and senate chairs of the joint committee on telecommunication, utilities and energy; the house and senate chairs of the joint committee on economic development and emerging technologies; the chief executive officer of the Massachusetts clean energy center; and 2 members of the offshore wind industry who shall be appointed by the governor. The commission shall file a report with its findings, including any legislative and regulatory recommendations, with the clerks of the senate and the house of representatives not later than 12 months after the effective date of this act.
