SECTION 1. Subparagraph (1) of paragraph (f) of subdivision (1) of section 24 of chapter 90 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the first paragraph the following paragraph:-
Notwithstanding the preceding paragraph to the contrary, a person with a previous conviction under this section whose license or right to operate is suspended for 3 years for refusal to submit to a chemical test or analysis of the person’s breath or blood may, after the expiration of 1 year of such suspension or during the pendency of any appeal having merits, apply for and shall be granted a hearing before the registrar for the purpose of requesting the issuance of a new license for employment or educational purposes which license shall be effective for not more than an identical 12 hour period every day on grounds of hardship.
SECTION 2. Said section 24 of said chapter 90 is hereby further amended by inserting after the word “permits”, in line 621, as so appearing, the following words:- , except as otherwise provided in this subparagraph,
