SECTION 1. Chapter 118E of the General Laws, as appearing in the 2016 official edition, is hereby amended by inserting the following new section:-
“Section 73A. (a) Notwithstanding the provisions of any general or special law to the contrary, the Secretary of Health and Human Services shall promulgate a process for the licensing and the licensing renewals of Personal Care Attendants. The process shall include but not be limited to performing a background check of applicants for their criminal histories, professional histories, and past violations of section 13K of chapter 265. The results of said background check shall be disclosed to all consumers or their surrogates who seek out the services of a Personal Care Attendant.
(b) All Personal Care Attendants shall be required to receive a license pursuant to the process promulgated in subsection (a) in order to advertise and operate as a Personal Care Attendant pursuant to this chapter.
SECTION 2. The provisions of this Act shall take effect no later than 1 year after its passage.
