An Act to establish a commission to determine whether EOHHS should be separated into two agencies with each being administered by a cabinet level secretary.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith a commission to study the operation and layout of the executive office of health and human services, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

A special commission is hereby established pursuant to section 2A of chapter 4 of the General Laws for the purpose of making an investigation and study relative to the operation and layout of the executive office of health and human services. The commission shall consist of 9 members: 3 of whom shall be appointed by the speaker of the house of representatives, 3 of whom shall be appointed by the senate president and 3 of whom shall be appointed by the governor. The commission shall study the benefits of dividing the executive office of health and human services into 2 executive offices, 1 of which would be the executive office of public health and oversight and would house all health agencies and 1 of which would be the executive office of human services and would house all human services agencies. The commission shall consider whether the executive office of health and human services has the management capacity to maintain an efficient level of services, including, but not limited to providing services to elders, youth, veterans and persons with disabilities.

The commission shall report to the general court the results of its investigation and study and its recommendations, if any, together with drafts of legislation necessary to carry its recommendations into effect, by filing the same with the clerk of the senate and the clerk of the house of representatives on or before June 1, 2022.
