SECTION 1. The first paragraph of subsection (c) of section 22 of chapter 90 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding the following 2 sentences:- The registrar shall review the facts of the motor vehicle violation prior to suspension, revocation, limitation or reinstatement of the right to operate a motor vehicle to ensure the conviction is properly categorized as equivalent as if said violation had occurred in the commonwealth. If the facts of said violation were exclusively for operating a vehicle at a rate of speed exceeding the speed limit for the way upon which the person was operating the registrar shall not: (1) suspend, revoke or limit the right to operate a motor vehicle or (2) impose any additional fine; provided, that any fine due to other state, country or jurisdiction was paid.
SECTION 2. There is hereby established a special legislative commission, pursuant to section 2A of chapter 4 of the General Laws, to make an investigation and study of establishing a new review process for receipt of an official notice that a resident of the commonwealth or any person licensed to operate a motor vehicle under the provisions of this chapter has been convicted in another state, country or jurisdiction of a motor vehicle violation. The commission shall consist of 9 members: 3 of whom shall be appointed by the speaker of the house of representatives, 3 of whom shall be appointed by the senate president and 3 of whom shall be appointed by the governor. The commission shall evaluate the benefits of the merit rating board reviewing all such official notices and making a recommendation, based on the facts of the violation, as to suspension, revocation, limitation or reinstatement of the right to operate a motor vehicle to the registrar.
The commission shall report to the general court the results of its investigation and study and its recommendations, if any, together with drafts of legislation necessary to carry its recommendations into effect, by filing the same with the clerk of the senate and the clerk of the house of representatives no later than February 28, 2022.
