Section 42 contained in the engrossed Bill making appropriations for the fiscal year 2022 for the maintenance of the departments, boards, commissions, institutions and certain activities of the Commonwealth, for interest, sinking fund and serial bond requirements and for certain permanent improvements (see House, No. 4002), which had been returned by His Excellency the Governor with recommendation of amendment (for message see Attachment J of House, No. 4019).  July 22, 2021.

An Act relative to parking fees on department of conservation and recreation roads.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to require forthwith local approval prior to the imposition of parking fees on department of conservation and recreation roads, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. The first paragraph of section 37 of chapter 92 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding the following 2 sentences:- No such rule or regulation shall provide for the collection of any charge or fee for parking on any boulevard, roadway, parkway, way or any portion thereof, under the jurisdictional care, custody or control of the commissioner, between regularly established curb lines or that part, exclusive of shoulders, improved and intended to be open and used for vehicular traffic by the public on a public way unless the commissioner has received prior approval from the local appropriating authority, as defined in section 21C of chapter 59, of the municipality in whose boundaries such charge or fee is collected on or after January 1, 2021. Any municipal approval of any rule or regulation providing for the collection of such charge or fee for parking prior to January 1, 2021 shall be inoperative for the purposes of this section.

SECTION 2. This act shall take effect as of July 1, 2021.
