To the Honorable Senate and House of Representatives,

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled “An Act Validating the Results of the Special Town Meeting Held on September 14, 2021 and the Special Election Held on September 21, 2021 in the Town of Leicester.”

I am filing this special legislation at the request of the Leicester Select Board.  The legislation ratifies and confirms all acts, proceedings, and votes taken by the Town at its special Town Meeting held on September 14, 2021 and special Town Election held on September 21, 2021.  This bill will serve to resolve in advance any questions that might arise from two minor deviations from required processes in connection with these proceedings: an oversight in not re-publishing the warrant for Town Meeting following a change in the originally announced meeting location and the omission of certain required steps in the preparation and distribution of ballot materials for the Town Election. 

Timely ratification of the special Town Meeting and special Town Election results is necessary to permit the Town to proceed with its planned purchase of the campus of the former Becker College before November 30, 2021.  I therefore urge your prompt consideration of this bill.

An Act validating the results of the special town meeting held on September 14, 2021 and the special election held on September 21, 2021 in the town of Leicester.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding any general or special law or by-law to the contrary, all acts and proceedings taken by the Town of Leicester at the special town meeting held on September 14, 2021 and the special town election held on September 21, 2021 and all actions taken pursuant thereto are hereby ratified, validated and confirmed, notwithstanding any failure to publish notice of the town meeting location pursuant to section 2 of chapter 4 of the Town bylaws or to comply with the provisions of section 18B of chapter 53 of the General Laws relating to the printing and making available of certain voter information prior to the election.

SECTION 2.  This act shall take effect upon its passage.
