An Act relative to the direct wine shipper license.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 19F of chapter 138 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking out subsections (a) and (b) and inserting in place thereof the following:-

Section 19F. (a) The commission may issue a direct wine shipper license pursuant to this section to any person, firm or corporation that holds a federal basic permit pursuant to the federal Alcohol Administration Act, compiled in 27 U.S.C. § 201 et seq.; and holds a license in the commonwealth or any other state to manufacture and export wine.

(b)  Under this section, a direct wine shipper licensee may make sales and delivery of wine directly to residents of the commonwealth who are 21 years of age or older, for personal use and not for resale; provided, however, a direct wine shipper licensee shall not sell at retail to such residents any wine or wine product not produced for or by the winery and sold under the winery’s brand name.
