An Act relative to regulation of hydrofluorocarbons substitutes.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. 

Chapter 143 of the General Laws is hereby amended by adding the following sections:

section 101. The state building code and specialized codes shall permit the use of any refrigerant listed as an acceptable substitute or safe alternative by the United States Environmental Protection Agency in the Significant New Alternatives Policy program, established pursuant to section 612 of the federal Clean Air Act, as codified in 42 U.S.C. 7671k ; provided, that any equipment using said refrigerant, including but not limited to freezers, refrigerators, refrigerator-freezers, and air conditioning equipment, shall be listed and installed in compliance with the safety standards required by the United States Environmental Protection Agency in said Significant New Alternatives Policy program established pursuant to said section 612 of the federal Clean Air Act, as codified in said 42 U.S.C. 7671k 

Section 102. Notwithstanding Section 101, a person who owns any equipment as inventory for sale, consumer good or business asset which uses a non-compliant refrigerant pursuant to Section 101, including but not limited to, freezer, refrigerator, refrigerator-freezer, and air conditioning equipment shall be exempted from Section 101 for the remainder of the useful life of the appliance.

SECTION 2. 

Sections 1 of this act shall take effect on January 1, 2024.
