An Act authorizing the city of Boston to grant five additional licenses for the sale of alcoholic beverages to be drunk on the specified premises.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.

(a)Notwithstanding section 17 of chapter 138 of the General Laws, the licensing board of the City of Boston may grant five additional licenses for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138. The licenses granted pursuant to this act shall be: (i) four restricted to the Bruce C. Bolling Municipal Building located at 2300 Washington Street in the Roxbury section of the City of Boston; (ii) one restricted to the Strand Theater located at 543 Columbia Road in the Dorchester section of the City of Boston (iii) non-transferable to any other person, corporation or organization; (iv) clearly marked "Bolling Building restricted" or "Strand Theater restricted", and "non-transferable" on its face; and (v) subject to all of said chapter 138 except said section 17.

(b)If the licenses granted pursuant to this act is canceled, revoked, or no longer in use, the licenses shall be returned physically, with all of the legal rights, privileges, and restrictions pertaining thereto, to the licensing board and the licensing board may then grant that license to a new applicant in the same location under the same conditions as specified in this act.

SECTION 2.

The provisions of this act are severable and if any provision, or portion thereof, should be held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect the remaining provisions, which remain in full force and effect.

SECTION 3.

This act shall take effect upon its passage.
