Comerford that the Montague Center Fire District be authorized to continue the employment of fire department members Gary Dion, David Hansen, Mark Fisk, Ann Fisk and Chris Rice, reports recommending that the accompanying bill (House, No. 5385) ought to pass.

An Act authorizing the Montague Center Fire District to continue the employment of fire department members Gary Dion, David Hansen, Mark Fisk, Ann Fisk and Chris Rice.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, Gary Dion, David Hansen, Mark Fisk, Ann Fisk and Chris Rice, members of the Montague Center fire department, may continue to serve in their positions until they reach 70 years of age, the date of their retirement or the date they are removed or suspended from office by the prudential committee of the Montague Center Fire District in accordance with applicable laws, rules or regulations, whichever occurs first; provided, however, that they remain physically and mentally capable of performing the duties of their positions. If requested, Gary Dion, David Hansen, Mark Fisk, Ann Fisk and Chris Rice shall, at the expense of the Montague Center Fire District, be examined by an impartial physician designated by the prudential committee to determine such capability. No further deductions shall be made from the regular compensation of Gary Dion, David Hansen, Mark Fisk, Ann Fisk or Chris Rice pursuant to chapter 32 of the General Laws for any service subsequent to reaching the age of 65 and, upon retirement, Gary Dion, David Hansen, Mark Fisk, Ann Fisk and Chris Rice shall receive a superannuation retirement allowance equal to that which they would have been entitled had they retired at 65 years of age.
SECTION 2. This act shall take effect upon its passage.
