SECTION 1. The second sentence of subsection (a) of section 5A of chapter 71B of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting after the word “chapter” the following words: --; provided that said program shall also reimburse municipalities for the eligible instructional costs associated with providing compensatory special education services for students who turn 22 or who otherwise become ineligible for special education services in the period between the governor’s declaration of a state of emergency due to
SECTION 2. Subsection (b) of said section 5A of said chapter 71B of the General Laws, as so appearing, is herby amended by adding the following sentence:--Instructional costs” shall also include those costs directly attributable to providing compensatory special education services for students who turn 22 or who otherwise become ineligible for special education services in the period between the governor’s declaration of a state of emergency due to COVID-19 on March 10, 2020 and three months after the date that the governor gives notice that the state of emergency has ended, provided that municipalities may be reimbursed for the eligible costs associated with providing compensatory special education services for said students for a period of time up to two years following the notice that the state of emergency has ended.
