An Act relative to wage and hour restrictions for retired public employees during the COVID-19 state of emergency.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith exemption from wage and hour restrictions for certain retirees, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, an individual who retired under a general or special law on disability and earned in excess of the allowable amount described in subsection (b) of section 91 of chapter 32 of the General Laws for hours worked during the governor’s March 10, 2020 state of emergency shall not be required to refund the compensation.

SECTION 2. If, pursuant to subsection (c) of said section 91 of said chapter 32, an individual who retired under a general or special law on disability returned compensation to the appropriate treasurer or other person responsible due to earnings in excess of the allowable amount described in subsection (b) of said section 91 of said chapter 32 for hours worked during the governor’s March 10, 2020 state of emergency, the treasurer or responsible person shall refund the compensation.
