An Act relative to the transfer of residents of disability licensed facilities.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 15A of chapter 19B of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after subsection (e) the following subsection:-
(e½) No facility licensed pursuant to this section, or any facility licensed under section 7 of chapter 19B, shall transfer a resident of the facility 20 or more miles from the permanent residential address of the resident’s legal guardian to another facility licensed pursuant to this section unless the resident’s legal guardian and case manager determine that the transfer is necessary after consultation with the resident. A facility may make recommendations to a resident, the resident’s guardian and case manager regarding the transfer of the resident to another facility licensed pursuant to this section, but shall not transfer a resident in violation of this subsection.
