An Act to reduce atmospheric pollution.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 31C of chapter 111 as appearing in the 2018 Official Edition, is hereby amended by inserting after the third paragraph the following paragraph:-
Rules and regulations adopted pursuant to this section may include imposition of a local surcharge on commercial parking spaces and/or a cap on the number of such spaces available in any city or town, or portion thereof. The board of health or other legal authority shall consider and take account of any other limitations on parking established pursuant to other legal authority in said city or town. Furthermore, the board of health or other legal authority may also vary the rate of surcharge based on the number of commercial spaces dedicated to zero emission vehicles. All funds derived from such surcharges shall be paid directly to the city or town to be used solely for the purposes of air pollution abatement, climate resilience and improvements in multimodal transportation infrastructure.
SECTION 2. This act shall take effect upon its passage.
