An Act establishing public safety employee COVID death benefits.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 100A of chapter 32, as appearing in the 2018 Official Edition, is hereby amended by inserting after subsection (j) the following subsection:-
(k) This section shall apply in the case of the death of a public safety employee as the direct and proximate result of COVID-19, unless the employee is shown to have performed no line of duty activity or action within the 20 days immediately preceding a diagnosis of or positive test for COVID–19, or the employee is not immunized to prevent COVID-19, unless the employee has medical conditions preventing immunizations or COVID-19 vaccines were not authorized for emergency use at the time of death.
