An Act relative to hydrokinetic energy.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 138 of chapter 164 of the General Laws is hereby amended by inserting in line 30 after the words “a Class I net metering facility that is not an agricultural net metering facility or that is not using solar” the words:- “, hydrokinetic,”

SECTION 2. Section 138 of chapter 164 of the General Laws is hereby amended by inserting in line 48 after the words “solar net metering facility,” the words:- “hydrokinetic net metering facility,”

SECTION 3. Section 138 of chapter 164 of the General Laws is hereby amended by inserting in line 67 after the words “solar net metering facility,” the words:- “hydrokinetic net metering facility,”

SECTION 4. Section 138 of chapter 164 of the General Laws is hereby amended by inserting the following new paragraph:-

“Hydrokinetic net metering facility,” a facility for the production of electrical energy that uses: (a) waves, tides, and currents in oceans, estuaries, and tidal areas; (b) free-flowing water in rivers, lakes, and streams; (c) free-flowing water in man-made channels; or (d) differentials in ocean temperature, called ocean thermal energy conversion to generate electricity and is interconnected to a distribution company.
