SECTION 1. Chapter 90 of the Massachusetts General Laws is hereby amended by inserting at the end of Section 1A, the following new section:-
Section 1A1/2. A motor vehicle or fleet of motor vehicles used for the purposes of providing a ride for hire by a limousine company or taxicab regulated pursuant Section 22 of Chapter 40 of the Massachusetts General Laws, may only be registered to operate in the Commonwealth of Massachusetts upon the approval of the registrar of each companies driver pre-employment and random drug and alcohol screening program. The registrar shall establish regulations for the minimum requirements of such a driver drug and alcohol-screening program.
SECTION 2. Chapter 159A1/2 is hereby amended in Section 2, by inserting after paragraph (m), the following new paragraph:-
(n) the division shall establish regulations providing for the minimum requirements for a driver pre employment and random drug and alcohol-screening plan. Each transportation network company shall annually provide the division with a driver pre employment and random alcohol and drug screening plan and certify annually that the plan has been implemented along with any additional driver information that the division may require.
SECTION 3. Chapter 159A1/2 is hereby amended in Section 3, by inserting after paragraph (x), the following new paragraph:-
(xi) that the applicant has a pre employment and random drug and alcohol screening plan in place that has been approved by the division.
