An Act relative to expanding equitable access to maternal postpartum care.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 118E of the General Laws is hereby amended by inserting after section 10A the following section:-

Section 10A ½. (a) Notwithstanding any general or special law to the contrary, the division shall continue MassHealth Standard coverage for pregnant and postpartum residents of the commonwealth who are eligible through Title XIX and Title XXI of the Social Security Act or under a Section 1115 Demonstration waiver to 12 months following the end of the pregnancy plus an additional period extending to the end of the month in which the 12 month period ends, regardless of any change in the resident’s family income.

(b) The same level and duration of MassHealth coverage established under subsection (a) shall be made available to pregnant and postpartum residents of the commonwealth regardless of immigration status.

(c) The Executive Office shall maximize federal financial participation for the coverage and benefits under this section, provided, however, that coverage and benefits provided under this section shall not be contingent upon the availability of federal financial participation.
