An Act relative to the town administrator in the town of Milton.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 65 of the Acts of 2016 is hereby amended by striking out the words “board of selectmen” everywhere they appear and inserting in place thereof the following words “select board”.

SECTION 2. Said chapter 65 is hereby further amended in section 2(d) by striking out the following words “Subject to the civil service laws and any collective bargaining agreements as may be applicable, the town administrator shall appoint, supervise and direct all department heads, except for the consolidated facilities director and town employees, who are under the jurisdiction of the board of selectmen” and inserting in place thereof the following words “Subject to the civil service laws and any collective bargaining agreements as may be applicable, the town administrator shall appoint, supervise and direct all department heads, except for the consolidated facilities director, and town employees who are under the jurisdiction of the select board.”

SECTION 3. Said chapter 65 is hereby further amended in subsection (j) of section 2 by striking out the word “to” immediately following the words “town are kept and” and immediately preceding the words “render, as often as”.

SECTION 4. Said Chapter 65 is hereby further amended in subsection (k) of section 2 by striking out the word “to” immediately following the words “needs of the town and” and immediately preceding the words “recommend to the select board”.

SECTION 5. Said chapter 65 is hereby further amended by striking out subsection (l) of section 2 and inserting in place thereof the following subsection:

(l) The town administrator shall have full jurisdiction over the short term rental and use of all town facilities and real property except real property that is under the control of the school committee, the board of library trustees, the board of park commissioners, the board of cemetery trustees, the Milton Housing Authority, the affordable housing trustees, or the conservation commission; provided, however, that the town administrator, together with the school superintendent, shall supervise and oversee the director of consolidated facilities, who shall be responsible for the maintenance and repair of all town buildings and facilities. Short term rental and use of facilities and real property shall mean rental and use that does not exceed 7 days.

SECTION 6. Said Chapter 65 is hereby further amended in subsection (o) of section 2 by striking out the word “to” immediately following the words “revenues and expenditures, and” and immediately preceding the words “prepare and present”.             

SECTION 7. Said chapter 65 is hereby further amended by striking out subsection (t) of section 2 and inserting in place thereof the following subsection:

(t) The town administrator shall submit to the select board and to town meeting, if necessary, plans to reorganize, consolidate or abolish departments or offices under the town administrator’s direction and supervision or to establish new departments and offices, or both, subject to enactment of home rule legislation if otherwise legally required.

SECTION 8. Said chapter 65 is hereby further amended in subsection (v) of section 2 by striking out the word “include” immediately following the words “Temporary signs shall” and immediately preceding the words “signs that are displayed” and insert in place thereof the word “mean”.

SECTION 9. Said chapter 65 is hereby further amended in subsection (w) of section 2 by striking out the word “to” immediately following the words “grants of location and” and immediately preceding the words “conduct public hearings”.

SECTION 10. This act shall take effect upon its passage.
