An Act authorizing the town of Billerica to transfer certain parcels of land.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary and pursuant to article 97 of the Amendments to the Constitution of the Commonwealth, the town of Billerica is authorized to transfer the care, custody and control of 2 parcels of land containing 105,863 square feet, more or less, in the aggregate and shown as “Area to be Removed From Conservation Restricted” on a plan of land entitled “Property Survey Conservation Area Land Swaps”, dated January, 2020 and revised on February 3, 2020, prepared by Weston & Sampson, currently held by the conservation commission for conservation purposes and subject to a conservation restriction held by and described in a deed from the commonwealth, acting by and through the division of capital asset management and maintenance, and recorded with the Middlesex south district registry of deeds in book 17119, page 146 , to the board of selectmen of the town for general municipal purposes.

SECTION 2. In consideration for the transfer of the land in section 1, the town of Billerica shall transfer the care, custody and control of a parcel of land containing 212,000 square feet, more or less, and shown as “Area to be Added to Conservation Restricted”, on a plan of land entitled “Property Survey Conservation Area Land Swaps”, dated January, 2020 and revised on February 3, 2020, prepared by Weston & Sampson , currently held by the board of selectmen of the town for general municipal purposes, to the Billerica conservation commission for conservation and passive recreation purposes under section 8C of chapter 40 of the General Laws. The parcel shall be subject to  Article 97 of the Amendments to the Constitution of the Commonwealth, and shall be added to the conservation restriction described in section 1 held by the commonwealth.

SECTION 3. This act shall take effect upon its passage.
