The charter of the city of Everett, as on file with the archivist of the Commonwealth in accordance with Massachusetts General Law Chapter 43B Section 12, is hereby amended as follows:
SECTION 1.
SECTION 2-3: PROHIBITIONS of the charter of the city of Everett shall be amended as follows:
SECTION 2-3(a)(1) shall be amended by inserting the phrase “said office is under the school department jurisdiction and ” between the words “unless” and “authorized”; and
SECTION 2-3(a)(1) shall be further amended by deleting the phrase “or by the state ethics commission”; and
SECTION 2-3(a) shall be further amended by inserting a new subsection (2) as follows and resequencing the existing subsection (2) accordingly:
“(2) A member of the city council shall not hold any appointed school department office or school department employment unless said office or employment was held one hundred twenty (120) days prior to nomination papers being pulled for city council position.”; and
The newly re-sequenced SECTION 2-3(a)(3) shall be amended by changing the phrase “thirty (30)” to “ninety (90)”); and
The newly re-sequenced SECTION 2-3(a)(3)(a.) shall be amended by changing the phrase “thirty (30)” to “ninety (90)”).
SECTION 2.
SECTION 2-4: COMPENSATION; EXPENSES of the charter of the city of Everett shall be amended as follows:
SECTION 2-4(a) shall be amended by adding a new subsection (3) as follows and resequencing the existing subsection (3) accordingly.
“(3) If authorized by the city council as a special municipal employee under chapter 268A of the General Laws, a city council member shall not collect compensation for the special municipal employee position if the member holds another compensated city employment or city office, including but not limited to employment or office under the school department jurisdiction.”.
SECTION 3.
SECTION 4-3: PROHIBITIONS of the charter of the city of Everett shall be amended as follows:
SECTION 4-3(a)(1) shall be amended by inserting the phrase “said office is under the jurisdiction of the administration or the legislature and ” between the words “unless” and “authorized”; and
SECTION 4-3(a)(1) shall be further amended by deleting the phrase “or the state ethics commission”; and
SECTION 4-3(a) shall be further amended by inserting a new subsection (2) as follows and resequencing the existing subsection (2) accordingly:
“(2) A member of the school department shall not hold any appointed city office or city employment unless said office or employment was held one hundred twenty (120) days prior to nomination papers being pulled for school committee position.”; and
The newly re-sequenced SECTION 4-3(a)(3) shall be amended by changing the phrase “thirty (30)” to “ninety (90)”); and

SECTION 4.
SECTION 4-4: COMPENSATION; EXPENSES of the charter of the city of Everett shall be amended as follows:
SECTION 4(a) shall be amended by adding a new subsection (2) as follows and resequencing the existing subsection (2) accordingly:
“(2) If authorized by the city council as a special municipal employee under chapter 268A of the General Laws, a school committee member shall not collect compensation for the special municipal employee position if the member holds another compensated city employment or city office.”.
SECTION 5. This act shall take effect upon its passage.
