An Act amending the provisions of chapter 177 of the acts of 2020, an act authorizing the transfer of care and control of certain parcels of land in the town of Bridgewater from the department of correction to the department of fire services.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Whereas, Section 5 of Chapter 177 of the Acts of 2020 allows the transfer of a 10-foot wide trail easement for non-motorized passive recreational use to the town, at no cost to the town, to be held by the conservation commission for the city known as the town of Bridgewater pursuant to Article 97 of the Amendments to the Constitution of the Commonwealth, and
Whereas, the transfer did not include areas for parking of up to ten cars for those wishing to access each end of the said easement, the location and impact of wetland areas, or the adequate width of an easement to accommodate variable terrain.
SECTION 1. Section 5 of Chapter 177 of the Acts of 2020 is amended by striking reference to the "10-foot wide easement" in the first sentence and inserting in place thereof the following text:- "50-foot wide easement."
SECTION 2. Section 5 of Chapter 177 of the Acts of 2020 is further amended by inserting after the words “commonwealth boundary” in the second sentence the following language: “ or as agreed by the commissioner of capital asset management, maintenance and the department of corrections, and the city known as the town of Bridgewater.”
SECTION 3. Section 5 of Chapter 177 of the Acts of 2020 is amended by inserting after the second sentence the following language:- "Such transfer shall include areas at both the northerly and southerly ends of the said 10-foot wide trail easement sufficient to construct parking areas for up to 10 vehicles, the precise locations of which shall be agreed by the commissioner of capital asset management, maintenance and the department of corrections, and the city known as the town of Bridgewater."
