An Act authorizing the conveyance of certain parcels of real estate by and between the department of conservation and recreation and the town of Holden.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding the provisions of general law chapter 30B or any other general or special law to the contrary, the town of Holden may convey the following two parcels of land to the commonwealth of Massachusetts to be held under the care, custody and control of the department of conservation and recreation for water supply protection and passive recreation under Article 97 of the Amendments to the Constitution of the Commonwealth: a parcel located off of North Street in Holden and shown on Assessors’ Map 44 as “Parcel 3,” containing approximately 9.67 acres of land, and a parcel located off of Meadow Wood Drive in Holden and shown on Assessors’ Map 161 as “Parcel 3,” containing approximately 11.65 acres of land.

SECTION2. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the commissioner of conservation and recreation, may in exchange for and in consideration of the conveyances of the two parcels from the town of Holden identified in Section 1 to the town of Holden, to be held under Article 97 of the Amendments to the Constitution of the Commonwealth, the following two parcels of land located in the town of Holden: a parcel located off of Salisbury Street in Holden and shown on Assessors’ Map 186 as “Parcel 5,” containing approximately 9.75 acres, and a parcel of land located off of Salisbury Street in Holden and shown on Assessors’ Map 186 as “Parcel 8, Parcel ID No. 7216,” containing approximately 8.66 acres of land. Said Parcel 5 shall be conveyed subject to a watershed preservation restriction held by the department of conservation and recreation under sections 31 to 33 of chapter 184 of the General Laws requiring the land to stay in a natural state.

SECTION 3. The conveyance authorized in Section 2 shall be granted only if the grantee agrees to assume the cost of any appraisals, surveys, and other expenses deemed necessary by the commissioner of capital asset management and maintenance for the transactions contemplated by this act.

SECTION 4. This act shall take effect upon its passage.
