Senate, July 31, 2022 -- Substituted as a new draft (Senator Cyr) for the Senate Bill authorizing the town of Nantucket to convey for roadway and any other purposes certain parcels of land within the roadway known as Ames Avenue, and shown as lots 35-38 (inclusive) in block 31 on land court plan no. 2408-m filed with the Nantucket registry district of the land court situated in the town of Nantucket held for conservation or recreational purposes to be conveyed for roadway and/or any purposes (Senate, No. 3081).

An Act authorizing the town of Nantucket to convey certain parcels of land acquired for conservation or recreational purposes.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the town of Nantucket may transfer, sell, convey or otherwise dispose of all or portions of certain parcels of land located in the town for roadway or other purposes.  The parcels are shown as lots 35 to 38, inclusive, in block 31 on a plan of registered land recorded in the Nantucket county registry of deeds as plan 2408-M.  The parcels were acquired by the town for conservation or recreational purposes by a deed recorded in said registry of deeds and registered as certificate number 22356.  The disposition of the parcels shall be on such terms and conditions as the select board deems appropriate; provided, however, that such terms and conditions may include the reservation of any easements and restrictions in regard to the property; and provided further, that such terms and conditions may also include the conveyance or dedication of town-owned land to ensure a no-net-loss of land in the town preserved under Article 97 of the Amendments to the Constitution of the Commonwealth, all as shown on a map entitled “2022 Annual Town Meeting Warrant Article 95 Home Rule Petition: Real Estate Conveyance A Portion of Ames Avenue”, dated January 2022 and filed in the office of the town clerk.

SECTION 2. This act shall take effect upon its passage.”
