An Act authorizing the town of Southbridge to grant additional licenses for the sale of all alcoholic beverages to be drunk on the premises.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding Section 17 of Chapter 138 of the General Laws, or any other general or special law to the contrary, the licensing authority of the Town of Southbridge may grant 7 additional licenses for the sale of alcoholic beverages to be drunk on the premises under Section 12 of said Chapter 138. The licenses shall be subject to all of said Chapter 138, except said Section 17.
SECTION 2. The licensing authority shall restrict the licenses granted under Sections 1 above to full service restaurants located in the Town of Southbridge with preference given to the Glove Village Flex Overlay District, the Central Core, and the American Optical Flex Overlay District. All applicants will provide their site plan review approval as part of their application.
SECTION 3. The additional licenses authorized by this Act shall be subject to an original one-time application fee of $5,000.00 more than the annual fee for existing alcoholic beverages licenses in the Town of Southbridge. The additional $5,000.00 fee shall be deposited into a Redevelopment Authority seed funding account for the purpose of allocating funds to the Redevelopment Authority towards economic development.
SECTION 4. The licenses issued pursuant to this Act shall be nontransferable to any other locations, persons, corporations, or organizations. If a license granted pursuant to this act is cancelled, revoked or no longer in use, the license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the licensing authority may then grant the licenses to a new applicant at a location within the zoning districts specified above under the same conditions as specified in this act.
SECTION 5. This Act shall take effect upon its passage or take any other action relative thereto.
