An Act to support disproportionate share hospitals.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 118E of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting the following new section:-

Section 13AA. Notwithstanding any general or special law to the contrary, the executive office shall include in its reimbursement rates to disproportionate share hospitals as defined under section 8A of chapter 118E an additional 3 percent to its inpatient adjudicated payment amount per discharge and an additional 3 percent to its outpatient adjudicated payment amount per episode of care; provider further, such rate adjustments shall be in addition to any  reimbursement rate adjustments for qualified safety net hospitals and shall not offset existing Medicaid payment adjustment in effect as of January 1, 2021 for which an eligible hospital may be qualified to receive; provider further, the executive office shall provide a supplemental payment of at least $15,000,000 for inpatient and outpatient behavioral and mental health services provided by disproportionate share hospitals subject to all required federal approvals and the availability of federal financial participation and shall be prioritized for services provided to children and adolescents.
