An Act relative to MassHealth.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 13C of chapter 118E of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after the first paragraph the following paragraph:-
The executive office shall not subject a nursing facility, as defined in 101 CMR 206.02, to a downward adjustment of its health care payments based on the failure of the facility to meet a specified number of hours per patient per day.
SECTION 2. The executive office of health and human services shall promulgate or amend any regulations necessary to implement this act.
