SECTION 1. Chapter 111 of the General Laws is hereby amended by inserting after section 150B the following section:-
Section 150C. (a) For purposes of this section ''solid waste'' shall mean garbage, refuse, trash, rubbish, sludge, residue or by-products of discarded material, and any other solid, semi-solid or liquid discarded material resulting from domestic, commercial, municipal, or other sources or activities, but shall not include solid or dissolved material in domestic sewage.
(b) An owner of a residential building including, but not limited to, the owner of a manufactured housing community as defined in section 32F of chapter 140 and the organization of unit owners of a condominium as defined in section 1 of chapter 183A, having 10 or more residential units shall fully secure and enclose on all sides any commercial disposal container for the disposal of solid waste on the premises so that the commercial disposal container is not visible to the general public. Violation of this section shall be punished by a civil fine of not more than $1,000.
(c)The commissioner shall promulgate regulations for the implementation, administration and enforcement of this section.
SECTION 2. The second paragraph of section 146 of chapter 266 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following sentence:- The owner or other person who has legal custody, care or control of the commercial disposal container shall be entitled to 10 per cent of the fine collected to assist with the costs of solid waste disposal.
