An Act to promote safe bicycle yielding.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The second paragraph of section 11B of chapter 85 of the General Laws, as amended by sections 1 and 2 of chapter 358 of the acts of 2022, is hereby further amended by adding the following 5 clauses:-

(12) The operator of a bicycle approaching a stop sign at an intersection with a roadway having 3 or more lanes for moving traffic shall come to a complete stop before entering the intersection.

(13) The operator of a bicycle approaching a stop sign at an intersection where a motor vehicle is stopped in the roadway at the same stop sign shall come to a complete stop before entering the intersection.

(14) The operator of a bicycle approaching a stop sign at an intersection with a roadway having 2 or fewer lanes for moving traffic shall reduce speed and if required for safety, stop before entering the intersection. After slowing to a reasonable speed or stopping, the operator of a bicycle shall yield the right-of-way to any motor vehicle, as defined in section 1 of chapter 90, in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time the operator of a bicycle is moving across or within the intersection except, that an operator of a bicycle after slowing to a reasonable speed and yielding the right-of-way if required, may cautiously make a turn or proceed through the intersection without stopping.

(15) The operator of a bicycle approaching an intersection shall always yield the right-of-way to any motor vehicle which has already entered the intersection; and

(16) When an operator of a bicycle enters an intersection with a motor vehicle from different roadways at approximately the same time, the operator of a bicycle or the motor vehicle on the left shall yield the right-of-way to the operator of a bicycle or the motor vehicle on the right.

SECTION 2. The first paragraph of section 14 of chapter 90 of the General Laws, as amended by sections 11 and 12 of said chapter 358, is hereby further amended by inserting after the thirteenth sentence the following sentence:- When a motor vehicle enters an intersection with an operator of a bicycle from different roadways at approximately the same time, the motor vehicle or operator of a bicycle on the left shall yield the right-of-way to the operator of a bicycle or the motor vehicle on the right.
