An Act relative to the odometer reading of a vehicle that is 25 years or older.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 90D of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following section:-
Section 39. (1) If an owner of an antique motor car, as defined in section 1 of chapter 90, discovers that the car mileage in their certificate of title was documented incorrectly upon transferring the certificate of title, under section 15, and after a new certificate of title in the name of the owner was issued by the registrar, under section 19, then the owner may appeal to the registrar, by mail or delivery of the certificate of title to the registrar, to correct the car mileage in the certificate of title. When appealing the certificate of title, the owner may include an affidavit or any other documentation in order to prove that the car mileage was incorrectly documented.
(2) If the registrar finds that the car mileage in the certificate of title was documented incorrectly when transferring the certificate of title, then the registrar shall issue a new certificate of title, with the correct mileage of the antique motor, in the name of the owner and mail it to the owner’s address. An appeal of the register’s ruling in this section is subject to section 30.
