An Act relative to parental notification about student health evaluations.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 57 of chapter 71 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following paragraph:-
If a child receives a deficient or failing assessment following any health examination conducted pursuant to this section, the person who conducted the examination or the school shall notify the parent or guardian of the child within 1 week of the date of the deficient or failed examination, prior to any subsequent assessment. The school shall notify the parent or guardian of a child who has received a deficient or failing assessment of the results of any subsequent assessment, regardless of the outcome of the subsequent assessment. Notification pursuant to this paragraph shall include: (i) the date of the screening; (ii) the name and address of the child; (iii) the name of the child’s school; (iv) the type of examination; (v) a summary of significant findings, including any follow-up measures planned by the school; (vi) information regarding educational assistance, where warranted; and (vii) the name, address and signature of the person who conducted the examination. Notification pursuant to this section shall be written in English and, where possible, the parent or guardian’s primary language.
