Chapter 25A of the General Laws is hereby amended by inserting, after section 16, the following section:-
Section 16A. Notwithstanding any general or special law to the contrary, no mandate related to the sale of electric vehicles, as defined in section 16 of chapter 25A of the General Laws, or prohibition on the sale of new gasoline or diesel vehicles shall take effect until the division of energy resources determines that the commonwealth has the electric infrastructure in place to support the increased use of electric vehicles. When determining whether the commonwealth has a sufficient electric infrastructure in place, the division of energy resources shall consider: (i) the number and location of electric vehicle charging stations, as defined in said section 16 of said chapter 25A, on residential and commercial properties; (ii) the ability of the commonwealth’s electric power grids to support the increased use of electric vehicles; and (iii) the reliability and affordability of charging an electric vehicle in the commonwealth.
