Section 19F of chapter 138 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by striking out subsections (a) and (b) and inserting in place thereof the following 2 subsections:-
(a) The commission may issue a direct wine shipper license pursuant to this section to a person, firm or corporation that is actively operating as a winery; holds a federal basic permit pursuant to the federal Alcohol Administration Act, compiled in 27 U.S.C. § 201 et seq.; and holds a license in the commonwealth or any other state to manufacture and export wine.
(b) Under this section, a direct wine shipper licensee may make retail sales and delivery directly to residents of the commonwealth who are 21 years of age or older, for personal use and not for resale, only of wine produced by or for the licensee and sold under the licensee’s brand name. For the purposes of this section, the term “brand name” shall also mean any wine exclusively produced by or for the licensee and marketed under a different label owned by or registered to the licensee.
