SECTION 1. Section 1 of Chapter 37 of the Acts of 2008 is hereby amended by striking out the first paragraph, and inserting in place thereof the following paragraph:-

Section 1.  Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the town of Weston may grant up to 2 licenses for the sale of wines not to be drunk on the premises under section 15 of said chapter 138 to food stores.  Except as otherwise provided herein, any such license issued hereunder shall be subject to all of said chapter 138 except said section 17.

SECTION 2. Said section 1 of said chapter 37 of the Acts of 2008 is hereby further amended by striking out the third and fourth paragraphs, and inserting in place thereof the following paragraphs:-

Notwithstanding any general or special rule or regulation to the contrary, the licensing authority shall not approve the transfer of a license granted hereunder to any other location, but a license may be granted at the same location if an applicant for such license files with the authority a letter in writing from the department of revenue indicating that the license is in good standing with the department and that all applicable taxes have been paid.

If a license granted under this section is canceled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges, and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location and under the same conditions as specified in this section.
