An Act authorizing the town of Plymouth to grant 2 additional licenses for the sale of all alcoholic beverages.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the town of Plymouth may grant 2 additional licenses for the sale of all alcoholic beverages not to be drunk on the premises pursuant to section 15 of chapter 138, to establishments located in Precincts 9 and17. Precincts 9 and 17 are located and bound as shown on a map titled "Precinct Map of Plymouth, Massachusetts," dated February 26, 2024, and on file in the office of the town clerk. The licenses shall be subject to all of said chapter 138 except said section 17. The licensing authority shall not approve the transfer of a license granted pursuant to this act to a location outside of Precinct 9 or 17 as those precincts are defined by the Precinct Map as on file with the town clerk dated February 26, 2024, but it may grant a license to a new applicant within Precinct 9 or 17 if the applicant files with the licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes, fees and contributions have been paid. A license granted pursuant to this act shall be clearly marked on its face “Precinct 9 or 17 only.” If a license granted pursuant to this section is cancelled, revoked or no longer in use the license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the Select Board and the Select Board may then grant the license to a new applicant at a location within Precinct 9 or 17 under the same conditions as specified in this act.
SECTION 2: This act shall take effect upon its passage. or take any other action relative thereto.
