SECTION 1. (a) Notwithstanding sections 33 to 37, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the commissioner of the department of conservation and recreation, shall convey a certain parcel of land in the city of Marlborough owned by the commonwealth to Louis G. Monti, Jr., of Marlborough, Massachusetts subject to this act.
(b) The property to be conveyed is a parcel of land in the city of Marlborough in the county of Middlesex containing 1,000 square feet, more or less, as shown on a plan entitled “Commonwealth of Massachusetts, Metropolitan District Commission, Water Division, Land in Marlboro to be conveyed to Pierina Monti, * * * February 1958, Harold J. Toole, Director of Water Division and Chief Water Supply Engineer.” The parcel is further described in a deed on file with the department of conservation and recreation from an ineffective conveyance to Pierina Monti dated May 22, 1958. The parcel shall be conveyed by deed without warranties or representations by the commonwealth.
SECTION 2. As consideration for the conveyance of the parcel described in section 1, Louis G. Monti, Jr. shall pay the commonwealth $1.
SECTION 3. Notwithstanding any general or special law to the contrary, the department of capital asset and maintenance shall pay for all costs and expenses of the sale of the parcel to Louis G. Monti, Jr. including, but not limited to, the costs of any recording fees and deed preparation related to the conveyance and all costs, liabilities and expenses of any nature and kind related to Louis G. Monti, Jr.’s ownership of the parcel.
SECTION 4. The department of capital asset management and maintenance, in consultation with the department of conservation and recreation, shall convey by deed to Louis G. Monti, Jr. the parcel described in section 1 not later than 120 days from the effective date of this act.
