SECTION 1. Notwithstanding any laws to the contrary, all residents of the Commonwealth over the age of 65 with an adjusted gross household income of $50,000 annually or less, are eligible for a prescription drug rebate.
SECTION 2. All prescription drugs, as defined in Section 1 of Chapter 94C of the General Laws, are eligible for the rebate program.
SECTION 3. Rebate shall be defined as a reimbursement for the total out of pocket expenses, including insurance co-pays, incurred by an eligible individual for prescription drugs. Rebates shall be disbursed to eligible individuals from the General Fund.
SECTION 4 .The Commissioner shall prescribe the process by which an eligible individual shall file for a rebate.
SECTION 5. Rebates shall not exceed $2,500 per individual annually
SECTION 6. The Commissioner shall report on the impact of this rebate program to the Committees of Ways & Means and the Joint Committee on Health Care Financing on an annual basis, commencing one year from the date the program goes into effect.
SECTION 7. This rebate program shall expire four years from the date of effect unless reauthorized by the legislature.
