An Act relative to proper disposal of products containing PFAS.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 111 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following new section:

Section 243. The department of environmental protection shall be charged with outlining the best practices and recommended regulations for the proper disposal of products containing per- and polyfluoroalkyl substances across the commonwealth.

The department shall review known locations of per and polyfluoroalkyl substances detection and create response plan strategies; identify the sources of per- and polyfluoroalkyl substances contamination and exposure pathways that pose the greatest risk to public health and the environment; and examine and estimate the cost to mitigate per- and polyfluoroalkyl substances contamination in known locations across the commonwealth.

The department shall file a report of its recommended regulations and its findings, together with drafts of legislation necessary to carry those recommendations into effect, by filing the same with the clerks of the senate and the house of representatives no later than one year after the passage of this act.
