An Act relative to plant medicine.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 94C of the General Laws, as so appearing in the 2020 Official Edition, is hereby amended by inserting after section 49 the following new section-:

Section 50: Entheogenic Plants and Fungi

Notwithstanding any general or special law to the contrary, all of the following shall be lawful for a natural person 18 years of age or older and shall not be a violation of state or local law:

The possession, ingestion, obtaining, growing, giving away without financial gain to natural persons 18 years of age or older, and transportation of no more than two grams of psilocybin, psilocyn, dimethyltryptamine, ibogaine, and mescaline, excluding the weight of any material such as water, plant and fungi material of which the substance is a part or to which the substance is added, dissolved, held in solution, or suspended.

“Financial gain” shall mean the receipt of money or other valuable consideration in exchange for the item being shared.
