An Act relative to fair software licensing.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 7D of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after section 11 the following section:-
Section 12. Fair software licensing
(a) The terms of a contract entered into by any state agency for the licensing of software applications designed to run on generally available desktop or server hardware shall not limit the ability of the state agency to install or run the software on the hardware of the agency’s choosing.
(b) The secretary of the executive office of technology services and security shall issue administrative directives to carry out this section.
SECTION 2. Section 1 of this act shall apply to any contract or addendum for the licensing of software applications on or after the effective date of this act.
