An Act authorizing the town of Tewksbury to use a certain parcel of land for general recreational purposes.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the change of use a certain parcel of land in the town of Tewksbury, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. (a) Section 1 of chapter 314 of the acts of 1993 is hereby amended by striking out, in line 6, the words “the expansion of the town of Tewksbury baseball facilities” and inserting in place thereof the following words:- general recreational purposes including, but not limited to, Tewksbury baseball facilities and other active and passive recreational activities.

(b) Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws, section 2 of chapter 314 of the acts of 1993 or any other general or special law to the contrary, the commissioner of capital asset management and maintenance may amend the restriction in a deed recorded in the Middlesex northern district registry of deeds in book 10054, page 109 to allow the parcel of land described therein to be used for general recreational purposes.

(c) Notwithstanding any general or special law to the contrary, the town of Tewksbury shall be responsible for all costs and expenses of any transaction authorized in this act as determined by the commissioner of capital asset management and maintenance including, but not limited to, the costs of any recording fees or deed preparation.
