The committee on Senate Ways and Means to whom was referred the House Bill relative to commercial driver's licenses (House, No. 5139); reports, recommending that the same ought to pass with an amendment striking out all after the enacting clause and inserting in place thereof the text of Senate document numbered 3002.

SECTION 1. Section 9 of chapter 90F of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking out, in line 21, the word “subsection” and inserting in place thereof the following word:- paragraph.
SECTION 2. Said section 9 of said chapter 90F, as so appearing, is hereby further amended by striking out, in line 96, the word “subsection” and inserting in place thereof the following word:- paragraph.
SECTION 3. Said section 9 of said chapter 90F, as so appearing, is hereby further amended by adding the following paragraph:-
(I) A person shall not be disqualified from operating a commercial motor vehicle under paragraphs (A) or (B) based upon convictions that occurred on or before September 30, 2005, unless: (i) the person has 3 or more convictions for operating under the influence under section 24 of chapter 90; or (ii) disqualification from operating a commercial motor vehicle is required under 49 C.F.R. 383.51 or any other federal statute or regulation.
SECTION 4. The registrar shall promulgate regulations pursuant to paragraph (C) of section 9 of chapter 90F of the General Laws not later than July 1, 2025.
