SECTION 1. Chapter 3 of the General Laws is hereby amended by adding the following section:-
Section 76. (a) There shall be a law revision commission which shall consist of: the chairs of the joint committee on the judiciary or their designees, who shall serve as co-chairs; the attorney general or a designee; 4 attorneys admitted to practice law in the commonwealth, 1 of whom shall be appointed by the president of the senate, 1 of whom shall be appointed by the speaker of the house of representatives, 1 of whom shall be appointed by the minority leader of the senate and 1 of whom shall be appointed by the minority leader of the house of representatives; 1 person to be appointed by the Massachusetts District Attorneys Association; 1 person to be appointed by the committee for public counsel services; and 3 persons to be appointed by the governor, 1 of whom shall be a retired judge, 1 of whom shall be a faculty member of an accredited law school in the commonwealth and 1 of whom shall be a historian with expertise in the laws of the commonwealth.
(b) The appointed members of the commission shall serve staggered 4-year terms. Vacancies in the membership of the commission shall be filled by the original appointing authority for the remainder of the unexpired term
(c) The commission shall: (i) examine common law, general and special laws of the commonwealth and judicial decisions to identify defects and anachronisms in the wording of certain laws and recommend any necessary reforms; (ii) receive and consider proposed amendments to such laws as recommended by the American Law Institute, the National Conference of Commissioners on Uniform State Laws, bar associations and any other learned bodies; (iii) receive and consider proposed changes to any language from judges, justices, public officials, lawyers and the public; (iv) recommend changes in the law to modify or eliminate antiquated and inequitable rules of law and to bring the law into harmony with modern conditions; (v) recommend the express repeal of statutes repealed by implication or held unconstitutional by a state or federal court; (vi) evaluate and make recommendations on the consolidation of session laws into the General Laws; and (vii) make recommendations to improve the openness and accessibility of state laws, including the use of open-source software tools.
(d) Counsel to the senate and counsel to the house of representatives shall jointly provide such personnel as may be necessary to coordinate the activities of the commission and assist the commission in drafting legislative proposals as requested.
(e) The commission shall meet at least 4 times annually. At the close of each regular session of the general court, the commission shall submit a report of its findings and recommendations, including drafts of proposed legislation necessary to implement those recommendations, to the clerks of the senate and the house of representatives, the house and senate committees on ways and means and the joint committee on the judiciary.
SECTION 2 Section 15F of chapter 6 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking out, in lines 2 and 3, the words “Employ Handicapped Persons Week” and inserting in place thereof the following words:- Persons with Disabilities Employment Week.
SECTION 3. Section 15LLLL of said chapter 6, as so appearing, is hereby amended by striking out, in line 2, the word “Autistic” and inserting in place thereof the following word:- Autism.
SECTION 4. Section 15OOOOO of said chapter 6, as so appearing, is hereby amended by striking out, in line 5, the words “disabled individuals” and inserting in place thereof the following words:- individuals with disabilities.
SECTION 5. Section 40 of said chapter 6, as so appearing, is hereby amended by striking out, in lines 4 and 5, the words “disabled American veterans” and inserting in place thereof the following words:- American veterans with disabilities.
SECTION 6. Section 56 of said chapter 6 is hereby amended by striking out, in line 48, as so appearing, the words “and handicapped persons” and inserting in place thereof the following words:- persons and persons with disabilities.
SECTION 7. Section 106 of said chapter 6, as so appearing, is hereby amended by striking out, in line 11, the words “who are disabled” and inserting in place thereof the following words:- with disabilities.
SECTION 8. Section 131A of said chapter 6, as so appearing, is hereby amended by striking out, in line 3, the words “the aged and disabled” and inserting in place thereof the following words:- aged persons and persons with disabilities.
SECTION 9. Section 131B of said chapter 6, as so appearing, is hereby amended by striking out, in lines 10 and 11, the words “the aged and disabled” and inserting in place thereof the following words:- aged persons and persons with disabilities.
SECTION 10. Section 143 of said chapter 6, as so appearing, is hereby amended by striking out, in line 11, the words “handicapped persons” and inserting in place thereof the following words:- persons with disabilities.
SECTION 11. Section 172 of said chapter 6, as so appearing, is hereby amended by striking out, in lines 92 and 93, the words “disabled person” and inserting in place thereof, in each instance, the following words:- person with a disability.
SECTION 12. Section 172C of said chapter 6, as so appearing, is hereby amended by striking out the definition of “Disabled person” and inserting in place thereof the following definition:-
“Person with a disability”, a person with an intellectual or a developmental disability as defined in section 1 of chapter 123B or who otherwise has an intellectual, developmental or physical disability and who, as a result of such intellectual, developmental or physical disability, is wholly or partially dependent on others to meet the daily living needs of such person with a disability.
SECTION 13. Said section 172C of said chapter 6, as so appearing, is hereby further amended by striking out, in lines 16 and 17, the words “disabled person” and inserting in place thereof the following words:- person with a disability.
SECTION 14. Said section 172C of said chapter 6, as so appearing, is hereby further amended by striking out, in line 18, the words “elderly or disabled persons” and inserting in place thereof the following words:- elderly persons or persons with disabilities.
SECTION 15. Said section 172C of said chapter 6, as so appearing, is hereby further amended by striking out, in lines 20 and 21, the words “disabled persons” and inserting in place thereof the following words:- persons with disabilities.

SECTION 231. Said section 1 of said chapter 121B is hereby further amended by inserting after the definition of "Operating agency”, as so appearing, the following definition:-
"Person with a disability of low income'', a person whose annual net income is less than the amount necessary to enable such person to maintain decent, safe and sanitary housing and who has been determined, pursuant to regulations issued by the secretary of housing and livable communities, to have an impairment which is expected to be of long, continued and indefinite duration, which substantially impedes the ability to live independently in conventional housing and which is of such a nature that such ability could be improved by more suitable housing conditions; provided, however, that except as required by federal law and notwithstanding any other law to the contrary, a history of alcohol or substance use shall not constitute a qualifying impairment; provided further, that eligibility for protection as a person with a disability under state or federal anti-discrimination laws shall not constitute a guarantee of eligibility for housing as a person with a disability of low income; and provided further, that a person who has a disability as defined in paragraph 17 of section 1 of chapter 151B shall still meet the definition herein in order to be eligible for housing as a person with a disability of low income.

“Person with a developmental disability'', (a) an individual 5 years of age or older with a severe, chronic disability that: (i) is attributable to a mental or physical impairment resulting from an intellectual disability, autism, Smith-Magenis syndrome or Prader–Willi syndrome; (ii) is manifested before the individual attains age 22; (iii) is likely to continue indefinitely; (iv) results in substantial functional limitations in 3 or more of the following areas of major life activity: (1) self-care; (2) receptive and expressive language; (3) learning; (4) mobility; (5) self-direction; (6) capacity for independent living; and (7) economic self-sufficiency; and (v) reflects the individual's need for a combination and sequence of special, interdisciplinary or generic services, supports or other assistance that is of an extended or lifelong duration and is individually planned and coordinated; or (b) an individual under the age of 5 who has a substantial developmental delay or specific congenital or acquired condition with a high probability that the condition will result in a developmental disability if services are not provided; provided, however, that a person who has a developmental disability may be considered to be mentally ill; and provided further, that no person with a developmental disability shall be considered to be mentally ill solely by reason of the person's developmental disability.
''Person with an intellectual disability'', a person who has a disability, characterized by significant limitations in both intellectual functioning and adaptive behavior as expressed in conceptual, social and practical adaptive skills beginning before age 18 and consistent with the most recent definition provided by the American Association on Intellectual and Developmental Disabilities; provided, however, that in applying this definition, the following shall be considered: (i) limitations in present functioning within the context of community environments typical of the individual's age, peers and culture; (ii) cultural and linguistic diversity and differences in communication, sensory, motor and behavioral factors; (iii) limitations often coexist with strengths within an individual; (iv) an important purpose of describing limitations is to develop a profile of needed supports; and (v) with appropriate personalized supports over a sustained period, the life functioning of a person with an intellectual disability will generally improve; provided further, that a person who has an intellectual disability may be considered to be mentally ill; and provided further, that no person with an intellectual disability shall be considered to be mentally ill solely by reason of the person's intellectual disability.

Section 5-309 of said chapter 190B, as so appearing, is hereby amended by striking out, in line 57, the words “or a mental retardation facility” and inserting in place thereof the following words:- intermediate care facility for individuals with intellectual or developmental disabilities.
SECTION 337. Section 5-404 of said chapter 190B, as so appearing, is hereby amended by striking out, in line 57, the words “be developmentally disabled” and inserting in place thereof the following words:- have an intellectual or a developmental disability.

SECTION 339. Section 32 of chapter 209 of the General Laws, as so appearing, is hereby amended by striking out, in line 6, the words “mental retardation” and inserting in place thereof the following words:- an intellectual or a developmental disability.

Section 25 of chapter 211 of the General Laws, as so appearing, is hereby amended by striking out, in lines 4 and 5, the words “mentally or physically disabled persons” and inserting in place thereof the following words:- persons with intellectual, developmental or physical disabilities.
SECTION 341. Said section 25 of said chapter 211, as so appearing, is hereby further amended by striking out, in lines 25 and 26, the words “disabled community” and inserting in place thereof the following words:- the disability community.
SECTION 342. Section 34 of chapter 215 of the General Laws, as so appearing, is hereby amended by striking out, in line 57, the words “is not disabled” and inserting in place thereof the following words:- does not have a disability.
SECTION 343. Section 9 of chapter 221A of the General Laws, as so appearing, is hereby amended by striking out, in lines 21 and 22, the words “elderly and handicapped individuals” and inserting in place thereof the following words:- elderly persons and persons with disabilities.
SECTION 344. Section 16 of chapter 224 of the General Laws, as so appearing, is hereby amended by striking out, in lines 5 and 6, and in lines 42 and 53, the words “handicapped person” and inserting in place thereof, in each instance, the following words:- person with a disability.
SECTION 345. Section 23E of chapter 233 of the General Laws, as so appearing, is hereby amended by striking out, in lines 36 and 50, the words “mental retardation” and inserting in place thereof, in each instance, the following words:- an intellectual or a developmental disability.
SECTION 346. Section 4 of said chapter 234A, as so appearing, is hereby amended by striking out, in line 29, the words “is permanently disabled” and inserting in place thereof the following words:- has a permanent disability.
SECTION 347. Said section 4 of said chapter 234A, as so appearing, is hereby further amended by striking out, in lines 36 and 37, the words “permanently disabled person” and inserting in place thereof the following words:- person with a permanent disability.
SECTION 348. Said section 4 of said chapter 234A, as so appearing, is hereby further amended by striking out, in lines 39, 41 and 44, the words “disabled person” and inserting in place thereof, in each instance, the following words:- person with a disability.
SECTION 349. Section 56 of said chapter 234A, as so appearing, is hereby amended by striking out, in lines 8 and 9, the words “handicapped and elderly jurors or handicapped and elderly dependents of jurors” and inserting in place thereof the following words:- elderly jurors and jurors with disabilities, elderly dependents of jurors or a juror’s dependents with disabilities.
SECTION 350. Section 34 of chapter 235 of the General Laws, as so appearing, is hereby amended by striking out, in line 56, the words “handicapped person” and inserting in place thereof the following words:- person with a disability.
SECTION 351. Section 9 of chapter 239 of the General Laws, as so appearing, is hereby amended by striking out, in lines 13 and 25, the words “handicapped person” and inserting in place thereof, in each instance, the following words:- person with a disability.
SECTION 352. Said section 9 of said chapter 239, as so appearing, is hereby further amended by striking out, in line 32, the words “handicapped persons” and inserting in place thereof the following words:- persons with disabilities.
SECTION 353. Section 5B of chapter 260 of the General Laws, as so appearing, is hereby amended by striking out, in line 5, the word “handicap” and inserting in place thereof the following word:- disability.
SECTION 354. Section 40 of chapter 262 of the General Laws, as so appearing, is hereby amended by striking out, in line 110, the words “disabled abuse” and inserting in place thereof the following words:- abuse of persons with disabilities.
SECTION 355. Section 13F of chapter 265 of the General Laws, as so appearing, is hereby amended by inserting after the word “intellectual, in lines 2, 3, 12, 13 14 and 15, each time it appears, the following words:- or developmental.
SECTION 356. Section 13F of said chapter 265, as so appearing, is hereby amended by striking out, in lines 21 and 22, the words “mentally retarded person” and inserting in place thereof, in each instance, the following words:- person with an intellectual or developmental disability.
SECTION 357. Section 39 of said chapter 265, as so appearing, is hereby amended by striking out, in line 11, the word “handicap” and inserting in place thereof the following word:- disability.
SECTION 358. Section 45 of said chapter 265, as so appearing, is hereby amended by striking out, in line 3, the words “mentally retarded person” and inserting in place thereof the following words:- person with an intellectual or a developmental disability.
SECTION 359. Section 123 of chapter 266 of the General Laws, as so appearing, is hereby amended by striking out, in lines 6 and 7, the words “and developmentally disabled persons” and inserting in place thereof the following words:- persons and persons with intellectual or developmental disabilities.
SECTION 360. Section 48 of chapter 271 of the General Laws, as so appearing, is hereby amended by striking out, in lines 4 and 5, the words “disabled veterans” and inserting in place thereof the following words:- veterans with disabilities.
SECTION 361. Section 34 of chapter 272 of the General Laws is hereby repealed.
SECTION 362. Said chapter 272 is hereby further amended by striking out section 35, as appearing in the 2022 Official Edition, and inserting in place thereof the following section:-
Section 35. Whoever commits a lewd and lascivious act with another person, in public, with the intent of public exposure or with reckless disregard for the substantial risk of public exposure, shall be punished by a fine of not more than $200, by imprisonment in a jail or house of correction for not more than 6 months or by both such fine and imprisonment.
SECTION 363. Section 53 of said chapter 272, as so appearing, is hereby amended by striking out, in lines 1 and 2, inclusive, the words “Common night walkers, common street walkers, both male and female, persons” and inserting in place thereof the following word:- Persons.
SECTION 364. Section 62 of chapter 272 of the General Laws is hereby repealed.
SECTION 365. Section 98A of chapter 272 of the General Laws, as so appearing, is hereby amended by striking out, in lines 2 and 3, and in lines 14 and 15, the words “,deaf or hearing handicapped person, or other physically handicapped person” and inserting in place thereof, in each instance, the following words:- person who is deaf or person with a hearing disability or other disability.
SECTION 366. Said Section 98A of said chapter 272, as so appearing, is hereby further amended by striking out, in lines 9 and 10, the words “or deaf or hearing handicapped or other physically handicapped person” and inserting in place thereof the following words:- person who is deaf or person with a hearing disability or other disability.
SECTION 367. Section 23 of chapter 273 of the General Laws, as so appearing, is hereby amended by striking out, in line 1, the words “needy disabled person” and inserting in place thereof the following words:- person with a disability.
SECTION 368. Section 57 of chapter 276 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking out, in lines 123 and 124, the words “or section thirty-four or thirty-five of chapter two hundred and seventy-two,”.
SECTION 369. Section 100E of said chapter 276, as so appearing, is hereby amended by striking out the definition of “Disabled person”.
SECTION 370. Said section 100E of said chapter 276, as so appearing, is hereby further amended by inserting after the definition of “Person” the following definition:-
“Person with a disability”, a person with an intellectual or a developmental disability as defined in section 1 of chapter 123B or who otherwise has a mental or physical disability and, as a result of such mental or physical disability, is wholly or partially dependent on others to meet daily living needs.
SECTION 371. Section 100J of said chapter 276, as so appearing, is hereby amended by striking out, in line 9, the words “disabled person” and inserted in place thereof the following words:- person with a disability.
SECTION 372. Section 45 of chapter 277 of the General Laws is hereby repealed.
SECTION 373. Section 63 of said chapter 277 is hereby amended by striking out, in line 29, as appearing in the 2022 Official Edition, the figures “, 34, 35”.
SECTION 374. Section 79 of said chapter 277, as so appearing, is hereby amended by striking out, in lines 427 to 429, inclusive, the words “Sodomy, etc. (Under Chap. 272, Sec. 34.)—That A.B. did commit the abominable and detestable crime against nature with a (state the person or beast).”.
SECTION 375. Said section 79 of said chapter 277, as so appearing, is hereby further amended by striking out, in lines 444 and 445, the words “Unnatural act. (Under Chap. 272, Sec. 35.)—That A.B. did commit an unnatural and lascivious act with one C.D.”.
SECTION 376. Item 3722-7870 and 3722-8846 of section 2 of chapter 167 of the acts of 1987 are hereby amended by striking out the words “department of community affairs”, each time they appear, and inserting in place thereof, in each instance, the following words:- executive office of housing and livable communities.
SECTION 377. Said items 3722-7870 and 3722-8846 of said section 2 of said chapter 167 are hereby further amended by striking out the words “handicapped persons”, each time they appear, and inserting in place thereof, in each instance, the following words:- persons with a disability.
SECTION 378. Said items 3722-7870 and 3722-8846 of said section 2 of said chapter 167 are hereby further amended by striking out the words “persons is handicapped” and inserting in place thereof the following words:- persons has a disability.
SECTION 379. Said items 3722-7870 and 3722-8846 of said section 2 of said chapter 167 are hereby further amended by striking out the words “secretary of human services”, each time they appear, and inserting in place thereof, in each instance, the following words: - secretary of health and human services.
SECTION 380. Item 3722-8871 of said section 2 of said chapter 167 is hereby amended by striking out the words “department of community affairs” and inserting in place thereof the following words:- executive office of housing and livable communities.
SECTION 381. The terms of the first members appointed to the law revision commission established in section 76 of chapter 3 of the General Laws shall be staggered as follows: (i) the attorney appointed by the speaker of the house of representatives, the attorney appointed by the president of the senate, the attorney appointed by the minority leader of the senate and the attorney appointed by the minority leader of the house of representatives shall each serve an initial term of 4 years; (ii) the persons appointed by the governor shall each serve an initial term of 3 years; and (iii) the person appointed by the Massachusetts District Attorneys Association and the person appointed by the committee for public counsel services shall each serve an initial term of 2 years.
