An Act relative to a local option for municipalities to own and operate their own internet provider.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 40 of the General Laws, as amended by section 9 of chapter 248 of the acts of 2024, is here by amended by adding the following section:-
Section 71. Notwithstanding any general or special law to the contrary, a city, town, municipality or district that accepts this section in the manner provided in section 4 of chapter 4 may own, operate, maintain or manage broadband high speed internet infrastructure and services or hire others to do so on its behalf and may take any reasonable action necessary to establish and operate broadband high speed internet infrastructure and services without establishing a municipal lighting plant.
