An Act relative to food truck licensure.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following section:-

Section 330. Mobile Food Establishment Licensure

For the purposes of this section, the term “mobile food establishment” shall mean a vehicle-mounted, self-contained food service operation, such as a food truck, designed to be readily moveable and used to store, prepare, display, serve, or sell food. The term “department” shall mean the Food Protection Program.

The Food Protection Program shall promulgate rules and regulations establishing legal standards and responsibilities for mobile food establishments. The department shall be the sole authority empowered to issue licenses for the operation of mobile food establishments. Such rules and regulations shall include, but not be limited to, the requirement that mobile food establishments pass an inspection conducted by the fire department in the municipality in which the mobile food establishment has its mailing address. Towns and municipalities may assess a fee on mobile food establishments operating in their jurisdiction.
