SECTION 1. Section 7 of chapter 90 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting, in line 80, after the words “such way.” the following sentence:- No motor vehicle so operated shall display a headlamp that: (i) flickers or cannot reliably sustain a consistent brightness level; (ii) is improperly installed; (iii) does not utilize pulse width modulation, or similar technology to prevent flickering; or (iv) does not meet certain other quality standards, as determined by the registrar.

SECTION 2. Said chapter 90 is hereby further amended by inserting after section 9D the following section:-

Section 9E. No person shall manufacture, sell or offer for sale or trade any motor vehicle headlamp that: (i) flickers or cannot reliably sustain a consistent brightness level; (ii) does not utilize pulse width modulation, or similar technology to prevent flickering; or (iii) does not meet certain other quality standards, as determined by the registrar

SECTION 3. Not later than 180 days following the passage of this act, the registrar of motor vehicles shall, pursuant to chapter 30A, promulgate regulations for the implementation of this act, which shall include quality standards for motor vehicle headlamps.
